In an effort to minimize tensions between you and your insureds, BARUSTORS can independently refer your insureds to experienced Cumis counsel at no cost to you or your insured client. At first glance, you may object to the idea of helping your insureds find Cumis counsel. You may reason that such help constitutes a conflict of interest --- similar to the conflict that necessitated the need for Cumis counsel in the first place. You may also argue that helping an insured find a good attorney will weaken your position if and when you exercise your right to deny coverage. However, we ask you to consider the following:
Second, if your insured is comfortable with the expertise of their legal counsel, they are less likely to interpret your reservation of rights as adversarial. Third, experienced insurance attorneys can save you the added costs of negotiating with a lawyer who is unfamiliar with insurance law, and who may raise unrealistic expectations in the insured’s mind. Fourth, experienced insurance attorneys can track covered vs. non-covered work for billing purposes. Fifth, the attorneys we refer bill at their normal rates, or at the rates you negotiate with them. There are no additional fees added to their service. Sixth, our referrals are free of charge to you and your insureds. Finally, your insureds are under no obligation to hire the attorneys we refer. Do you run your insurance company's claims department? If so, we invite you to tell your Cumis clients about us. Whether or not they call us is their business, but you will have done your part in pointing them to experienced insurance attorneys. Even large corporate clients may need assistance locating Cumis counsel for claims that are filed outside of their home state.
